LIMITATIONS (p-5)
Pontiac and at a charge not exceeding $25.00, will then issue a new Protect-O-Plate for insertion in the Owner Protection Plan booklet to identify that person as a Warranted Owner for any unexpired portion of the 5 year/50,000 mile Warranty.
The first owner who acquires the Vehicle for use and not for resale, following disposition of the Vehicle by the first Warranted Owner after the date of expiration of the 24 month/24,000 mile time and mileage limits of this Warranty, may become a Warranted Owner by submitting to Pontiac through an authorized Pontiac Dealer a properly executed Warranty Application form together with the first Warranted Owner’s Protect-O-Plate within 30 days or 1,000 miles usage following the date of acquisition. If the Vehicle is still within the time and mileage limits of this Warranty and there is satisfactory evidence that the maintenance services required under this Warranty have been performed on the Vehicle, Pontiac will register the Vehicle owner as the Warranted Owner and the authorized Dealer, acting for Pontiac and at a charge not exceeding $25.00, will issue a new Protect-O-Plate for insertion in the Owner Protection Plan booklet to identify that person as a 5 year/50,000 mile Warranted Owner.
LIMITATIONS
Pontiac’s Obligation—Pontiac’s obligation under this Warranty is limited to repairing or replacing, at its option, any part or parts which are returned to an authorized Pontiac Dealer at such Dealer’s place of business and which examination shall disclose to Pontiac’s reasonable satisfaction to have been defective in material or workmanship. Repair or replacement under this Warranty shall be performed by any authorized Pontiac Dealer at such Dealer’s place of business without charge for replacement parts or labor.
Owner Responsibility—Condition—In the event warranty repairs become necessary on power train, suspension or steering components, it is an express condition of this Warranty that the Warranted Owner furnish the authorized Pontiac Dealer evidence that the engine oil, oil filter, carburetor air filter, positive crankcase ventilator valve, engine coolant, propeller shaft, and front and rear suspension and steering components (and automatic transmission fluid and transmission band if so equipped) have been serviced in accordance with Pontiac’s required maintenance schedule, as stated in the Pontiac Owner Protection Plan booklet, to the extent related to such warranty repairs.
Owner Responsibility—Validation—As an express condition to this Warranty continuing in effect during the specified time and mileage limits on power train, suspension and steering components, the Warranted Owner is required to furnish an authorized Pontiac Dealer evidence, 12 months after the date the Vehicle was placed in use by the First Warranted Owner and each 12 months thereafter, for so long as this Warranty is in effect, that such components have been serviced in accordance with Pontiac’s required maintenance schedule, as stated in the Pontiac Owner Protection Plan booklet, and have the Dealer certify in such booklet (1) that the Dealer has received such evidence, and (2) the then current indicated mileage on the odometer.
Odometer Mileage Alteration—This Warranty shall not apply to any Vehicle on which the odometer mileage has been altered and the Vehicle’s actual mileage cannot be readily determined.
Exclusions—This Warranty shall not apply to (1) any Vehicle for which the then owner does not possess a Protect-O-Plate issued by Pontiac in owner’s name for such Vehicle, (2) any Vehicle which has been subject to misuse, negligence, alteration or accident, or which shall have been repaired outside of an authorized Pontiac Dealer’s place of business in any way so as, in the reasonable judgment of Pontiac, to affect adversely its performance and reliability, (3) normal maintenance services (such as engine tune up, fuel system cleaning, carbon or sludge removal, brake and clutch adjustments and wheel alignment and balancing), (4) the replacement of service items (such as spark plugs, ignition points, positive crankcase ventilator valves, filters and brake and clutch lining) made in connection with normal maintenance services, (5) normal deterioration of soft trim and appearance items due to wear and exposure, or (6) any vehicle registered and normally operated outside the United States or Canada (the warranty applicable to such vehicle shall be that authorized by General Motors in the country where such vehicle is registered and normally operated).
SOLE WARRANTY
This Warranty is the only warranty applicable to the Vehicle and is expressly in lieu of all other warranties, expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose, and of any other obligation or liability on the part of Pontiac, and Pontiac neither assumes nor authorizes any other person to assume for it any other obligation or liability in connection with such Vehicle.
